Terms of Service

These Terms of Service govern access to and use of Sub9bar, offered by Alejandro José Sobrino Beltrán ("the owner"), based in Esporles, Illes Balears, Spain. By creating an account or using the service, you agree to be bound by these terms.
1. Service description
Sub9bar is a progressive web app (PWA) for espresso calibration. It lets you log shots with their parameters (dose, yield, time, temperature, taste scores), manage your beans and equipment, and receive AI-generated adjustment suggestions.
The service is developed and maintained as a personal project. No service level agreement (SLA) or uninterrupted availability is guaranteed.
2. Access and eligibility
To register you must be at least 16 years old (the minimum age for data processing consent in Spain). You can sign up with an email and password or via Google OAuth.
3. Plans and access
3.1 Free plan
Free access with a limit of 30 shots per calendar month. AI analysis is not available on this plan. The limit resets automatically on the first day of each month.
3.2 Founder access
Founder access is a promotional offer limited to the first 250 people who sign up through the link with the referral code ?ref=founder. It grants full access to the service for 90 calendar days at no cost.
After 90 days, the account automatically reverts to the Free plan unless the user has subscribed to Pro before that date. During the 14 days following the expiry of Founder access, the user will have a special offer to upgrade to Pro Founder.
Founder access is offered in exchange for feedback about the service. The owner may contact Founder users to request their opinion.
3.3 Pro plan
The Pro plan provides unlimited shots and full access to AI analysis through a recurring paid subscription. The price and billing period are displayed during checkout before confirming payment. Payments are processed through Stripe.
4. Payments, renewal and cancellation
Your Pro subscription renews automatically at the start of each period (monthly or annual, as selected) using the payment method associated with your Stripe account.
You may cancel your subscription at any time from Account → Manage subscription. Cancellation takes effect at the end of the already-paid period; no pro-rated refunds are issued for unused time within that period.
5. Right of withdrawal
In accordance with Article 16(m) of EU Directive 2011/83/EU (implemented in Spain by Royal Legislative Decree 1/2007), by confirming payment and requesting immediate access to the digital service, you expressly acknowledge that you waive the 14-day right of withdrawal applicable to distance contracts, given that the service begins immediately with your consent.
6. AI-generated suggestions
Calibration suggestions generated by AI are purely indicative and based on parameters entered by the user. They do not constitute professional advice, and the owner does not guarantee that applying them will produce the desired results. The user is at all times responsible for the use of their equipment.
7. Ownership of user data
Your shots, beans and equipment are your data. We never use them for purposes other than those described in the Privacy Policy. You may delete your account and all your data at any time from within the app.
8. Acceptable use
The following are prohibited:
- Using the service for unlawful or fraudulent purposes.
- Attempting to access other users' accounts or data.
- Making bulk automated requests that affect service availability.
- Reselling or sublicensing access to the service to third parties.
Breaching these conditions may result in suspension or deletion of your account without prior notice.
9. Service availability and modifications
The owner reserves the right to modify, suspend or discontinue any feature of the service. In the event of material changes that negatively affect users with an active subscription, notice will be given by email at least 30 days in advance.
The owner may also update these Terms of Service. Changes will be communicated by email, and continued use of the service after notification implies acceptance of the new terms.
10. Limitation of liability
To the maximum extent permitted by applicable law, the owner shall not be liable for indirect, incidental or consequential damages arising from the use or inability to use the service. In no event shall the owner's total liability exceed the amount paid by the user in the 12 months prior to the event giving rise to the claim.
11. Governing law and jurisdiction
These Terms are governed by Spanish law. For any dispute that cannot be resolved amicably, the parties submit to the courts and tribunals of Palma, Illes Balears, expressly waiving any other jurisdiction that may apply to them.
